Barro Group recognises that through your dealings with us, you are placing trust in us and we want to maintain that trust.  We are committed to the protection of your personal information.

In this document, Barro Group refers to Barro Group Pty Ltd and its related bodies corporate as defined in the Corporations Act.

This Privacy Policy applies to the collection, use, disclosure and handling of personal information by Barro Group Pty Ltd and its related bodies corporate (collectively “Barro Group”, “we” and “us” and “our”) including personal information collected via our www.barro.com.au and/or Barro linked/related websites (the “website”).     Barro Group recognises the importance of protecting the privacy and the rights of individuals in relation to their personal information.  We respect your rights to privacy under the Privacy Act 1988 (Cth) (the Act) and the Australian Privacy Principles (APPs) and including the Privacy Amendment (Notifiable Data Breaches) Act 2017 which established the Notifiable Data Breaches Scheme (Part IIIC of the Privacy Act 1988).

This Policy should be considered in light of affiliated Barro Group policies and regulatory matters (if any) such as use of emails, Spam Act, Facebook Protocols and our social media policies, and even the Do Not Call Act. Most of these mentioned may not necessarily directly deal with 'personal information' as defined in the Act but extend to uses of data that may incidentally include personal information.

You consent to us collecting, holding, using and disclosing your personal information in accordance with this policy.

What is personal information?

Personal information is any information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be personal information regardless of whether it is true.

What personal information do we collect and hold?

In this privacy policy, the term ‘personal information’ has the meaning given to it in the Act. Personal information that we collect relates to your dealings with us and may include (but is not limited to) the following types of personal information:

• your name, date of birth, driver’s licence details, mail, email and street addresses (current and previous), telephone/mobile and facsimile numbers, profession, occupation, job title and work history, bank details, commercial credit reference details, photos and videos, personal information about your visit to one of our sites;
• details of the products and services you have purchased from us, or which you have enquired about, together with any additional information necessary to deliver those products and services, respond to your enquiries and generally to complete any commercial transaction between us;
• details of the products and services that we may purchase, have purchased or enquired about from you, together with any additional information necessary for us to respond to your enquiries and generally to complete any commercial transaction between us;
• any additional information relating to you that you provide to us directly through our website or indirectly through use of our website or online presence, through our representatives or otherwise, and
• information you provide to us through our ordering centres, customer surveys and/or visits by, or telephone calls from, our representatives from time to time;
• personal information provided by an individual in response to a request, director or order;
• personal information about an individual provided by another entity in response to a request, direction, order or arrangement for sharing or transferring information between both parties;
• personal information provided at a business meeting, where it relates to the subject matter of the meeting, including business cards exchanged at the meeting;
• a completed form or application submitted by an individual;
• a record of a credit card transaction;
• video footage that identifies individuals; and
• an employment application.

The personal information collected and used by Barro Group can be provided or used electronically or by conventional methods and the principles of protection apply equally to all information mediums.

We may also collect some information that is not personal information because it does not identify you or anyone else.  For example, we may collect anonymous answers to surveys or aggregated information about, for example, our products and services and how users use our website.

We do not collect tax file numbers or other government identifiers of individuals, except as a legal necessity. If you are an individual or organisation carrying on a business we will collect and use the ABN of that business for our business and tax requirements

In every mode of collection or use, we follow the guidelines and rules laid down by the Australian Privacy Principles. Our compliance procedures can be overridden by legal process - law enforcement, regulatory intervention, and emergency health or safety issues all take priority to our protocols and procedures.

How do we collect your personal information?

We will collect your personal information directly from you whenever you interact with us.

We collect the information in numerous ways – telephone, internet, email, and written correspondence. Other sources of collection of that personal information may include -

• registration forms, invitations and expressions of interest forms for briefings, interest groups, training courses;
• membership applications, notices, invoices and order forms;
• forms and notices for statutory compliance purposes (such as consents to act);
• surveys and questionnaires;
• project and consultancy proposals and contracts for services;
• telephone and email enquiries to our offices;
• email broadcasts;
• business cards;
• publicly available directories and publications.

In some cases, we collect information using the services of a formal personal information collection agency or third party.  Where you provide us with personal information about someone else, you must ensure you have that individual's consent to giving it to us, especially if it is an employee or contractor to you.  

Our online facilities such as web browsers, log information collectors and cookies do not collect personal data about individuals. You can disable cookies and opt out of on-line advertising, but there is a risk that in doing so, you and your business may not receive the services you have sought from us or updates or other information pertinent to our relationship with you.

We may also collect information from third parties such as training organisations, credit agencies, referral services.

Sensitive Information

We may in selected specific circumstances, have to ask for sensitive information such as affiliation or membership of a union, or health status (including as may be applicable, COVID-19 vaccination status), and background in the context of employment and regulatory advice provided as part of our primary purpose. We may seek information which is expressly required by a law or regulation or is required or relevant to our purpose or the services we provide, including for our employment purposes (e.g. in the case of Workplace Health and Safety, Fair Work or Industrial Relations). Sensitive information is treated separately and more confidentially and is destroyed if it is no longer needed for the purpose. We will require your written consent to the disclosure of information that contains sensitive information if such disclosure is required (e.g.  confirmation of employment details where an employee is seeking a personal bank loan).  Barro Group has relevant security measures such as restricted access to limited approved parties as and when required, for example in the case of sensitive information for employment purposes.

Website access

We may collect de-identified information about how you access, use and interact with the website. We do this by using a range of tools such as Google Analytics. This information may include:

1. the location from which you have come to the site and the pages you have visited; and
2. technical data, which may include IP address, the types of devices you are using to access the website, device attributes, browser type, language and operating system.

We use cookies on the website. A cookie is a small text file that the website may place on your device to store information. We may use persistent cookies (which remain on your computer even after you close your browser) to store information that may speed up your use of our website for any of your future visits to the website. We may also use session cookies (which no longer remain after you end your browsing session) to help manage the display and presentation of information on the website. You may refuse to use cookies by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to use the full functionality of the website.

Use and disclosure

Barro Group may use or disclose your personal information for the purposes:

• for which it was collected;
• of providing relevant services and products to you, and to manage our relationship with you
• of administering and managing those services and products, including charging, billing and collecting debts;
• of conducting appropriate checks for commercial credit-worthiness and fraud;
• of promoting and marketing to you other services or products which we consider may be of interest to you, unless you contact us and tell us not to do so;
• to comply with out legal obligations and assist government and law enforcement agencies or regulators
• to ensure that we maintain a safe working environment;
• for which you have consented; and as otherwise authorised or required by law

We may grant commercial credit to an individual (in their capacity as a sole trader or partner of a partnership) who wishes to purchase our products for re-supply. Before doing so, we typically obtain a commercial credit reference check. Such a check may be provided by a company who also carries on business as a credit reporting body who provides credit eligibility information about consumer credit. Where we obtain information from a commercial credit reference check, we will apply the same practices described in this policy as if it were personal information.

How your information is stored

We take all reasonable steps and precautions to keep any personal information we hold about you secure.  It is either de-identified, destroyed or returned to you if no longer needed, or stored securely in either paper or electronic form. 

Any personal or other information transmitted to us online is at your own risk as we are unable to provide any assurance regarding the security of transmission.

Except to the extent liability cannot be excluded due to the operation of statute, Barro Group excludes all liability (including in negligence) for the consequences of any unauthorized access to your personal information.  Please notify us immediately if you become aware of any breach of security.

How do we collect your personal information

We collect personal information directly from you where it is reasonable and practicable to do so, such as, for example, in ways including 

• through your access to our website;
• during conversations between you and our representatives;
• directly from you such as when you complete an application, provide information over the telephone, via our website or in other documents;
• through you participation in our procurement processes;
• via security cameras/videos at our premises;
• inboard vehicle and other camera and video systems.

We may also collect your personal information from third parties including, for example, your representative, credit reporting bodies, our subsidiaries, publicly available sources of information, credit reporting agencies, business data providers, professional and/or industry associations, law enforcement agencies and other government entities etc.

Cookies
In some cases we may also collect your personal information through the use of cookies. When you access our website, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer.

We may log IP addresses (that is, the electronic addresses of computers connected to the internet) to analyse trends, administer the website, track users’ movements, and gather broad demographic information.

We may contact you via email, SMS, or other means in order to provide you with updated information or to provide you with information about our products and services or with other information. 

Disclosing your information

Disclosure of your personal information, in certain limited circumstances, to third parties is subject to privacy and confidentiality protections we deem appropriate.  Usually we disclose information to, but not limited to:

• our employees and related bodies corporate;
• outsourced service providers who manage the services we provide to you, including but not limited to those who manage our customer inquiries/mailing systems/billing and debt-recovery functions/marketing functions/ email filtering, virus scanning and other technology services providers/archival services providers/external photocopying providers;
• government / regulatory authorities and other organisations, as required or authorised by law;
• credit-reporting and fraud-checking bodies;
• other credit providers for commercial credit related purposes such as credit-worthiness and financing;
• our financiers;
• our professional advisers and consultants, including our accountants, auditors and lawyers; and
• your representatives (eg your legal advisers).

These organisations may be located outside Australia.

How can you access, correct or delete your personal information

If you wish to access, correct or update any personal information we may hold about you, please contact our Privacy Officer as set out below.  We may refuse access where the Act allows us to do so.

Changes to our Privacy Policy

This is our current Privacy Policy.  We may change this Privacy Policy at any time at our discretion.  By continuing to deal with us, or otherwise continuing to use the website, you accept this Privacy Policy as it applies from time to time.
